Cost of a divorce and who pays?

If the divorce is due to a number of differing factors including adultery, dissertation etc. (grounds for divorce)then you can ask the court to order your spouse to cover your legal costs in relation to the divorce proceedings
Do I have to attend Court?
If both of you are happy to let the divorce proceed then you will not have to attend court. The court will produce the documents required.
However, two factors will mean you have to attend divorce court:
- If the divorce is defended
- A costs order ordered and defended
How long will it take?
“Quickie Divorces” do not exist. All divorces must go through the courts and it decides the time it will take.
Normally, a divorce ( financials excluded) can takes between 5 to 7 months.
If there are financial implications it can take a lot longer.
If we both want a divorce is a easier to get one?
Currently not at the moment. One of you must prove that the marriage has completely broken down. This is determined by 1 of 5 facts (all in relation to your spouse):
- Unreasonable behaviour
- 2 years separation and divorce is wanted by both parties
- 5 years separation
Is it just a split in finances, half each?
This is where it can get complicated, much more than the actual divorce proceedings.
